Terms of Use

If you continue to browse and use the NACEL Data and Improvement Tool you are agreeing to comply with and be bound by the following terms and conditions of use. These, together with the NHS Benchmarking Network’s Fair Processing Notice and the NACEL Privacy Notice, govern NHS Benchmarking Network’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use the NACEL Data and Improvement Tool website.

The term ‘NHS Benchmarking Network’ or ‘us’ or ‘we’ refers to the owner of the website, the term ‘you’ refers to the user or viewer of our website including the organisation they are employed by.

By logging in and/or using the NACEL Data and Improvement Tool you are agreeing to the following. You also acknowledge that this agreement may change from time to time without notice to you, whereby continuing use of this website constitutes your acceptance of and agreement to any such changed terms and conditions and policies.

The use of this website is subject to the following terms of use:

  • The results in the NACEL Data and improvement Tool are published before the national report. HQIP and the audit funders, have agreed to release the data ahead of publishing the report to support local quality improvement. You must not share any national, regional, or local findings or data outside of your organisation until after the national report has been published.

  • The content of the pages on this website is for your information and Organisation’s use only. The data displayed is available to those participating in NACEL 2024 and those who have been approved by the Site Administrator from the participating Organisation. Use of the NACEL data should be treated under your Organisation’s Professional Code of Conduct and used to support the provision of health and care services. Organisations with third party access to the data is covered within the NACEL Data Protection Impact Assessment (DPIA).

  • The intended use of the NACEL data is to support local quality improvement. The data will be used only for the intended purpose and not for anything that could harm the data owner or violate laws or regulations.

  • The Data and Improvement Tool displays the results from a growing NACEL dataset, where the positions will change throughout the year. This should be taken into consideration when using and interpreting the results. For example, the Case Note Review and Quality Survey data is live fed into the tool to support real time reporting. Data accuracy will be reviewed throughout the audit to ensure erroneous data is removed in a timely manner.

  • This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

  • Unauthorised use of this website may give rise to the prohibition from future use by you the user and the organisation from which you represent.

  • From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

  • Every effort is made to keep the website up and running smoothly. However, NHS Benchmarking Network takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

  • Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales.

 Account Misuse

NHS Benchmarking Network reserves the right to close without warning any accounts being used for any other purpose than for the provision of information held in the Data Improvement Tool to the individual subscriber.

Possible forms of misuse include, but are not restricted to the following:

  • Data theft - information provided is for the benefit of the individual user, and the participating Organisation’s account only, and must not be shared, published, or otherwise disseminated in any way outside of the Organisation;

  • Login Sharing – each user login is personal. The sharing of login details is strictly prohibited without written permission from the Host or the NACEL/Network Support Team;

  • Incorrect information - if the information you provide about yourself is false or incorrect you may be denied access to your account or your account may be closed.

In the event an authorised user ceases to be an employee of the provider Organisation, the Host or the NACEL/Network Support Team should be promptly notified to ensure that the user login of that authorised user is no longer accessible by that authorised user.
